Smoking/vaping in public places
Smoking and vaping is banned in all enclosed public areas and certain outdoor public areas, under the Smoke-free Environment Act 2000 and the Smoke-free Environment Regulation 2016.
Selling tobacco and/or vaping goods or nicotine pouches
Tobacco retail and wholesale laws in NSW regulate the packaging, advertising and display of tobacco products (including shisha) and non-tobacco smoking products, and ban the supply of these products to people under 18 years.
Vaping goods can only be sold by a pharmacy, it is illegal for all other retailers to sell these products.
It is illegal to sell nicotine pouches unless dispensed by a pharmacy on a valid prescription.
